That the Parliament notes with concern reports of the developing situation in Pakistan regarding the repeated arrest and detention of elected Senator Azam Khan Swati, beginning in October 2022, as reported in Pakistani news outlets; understands that Senator Swati has been placed in prolonged periods of remand with limited access to legal assistance for tweeting criticism of a senior military official, the former army chief, General Qamar Javed Bajwa; considers that the motivation for his arrest was contrary to basic principles of freedom of expression and that human rights violations are alleged to have occurred in the mistreatment of Senator Swati; believes that freedom of expression and of debate is a fundamental principle for parliamentary democracies; further believes that those in government and military leadership are never above the scrutiny of parliamentarians; recognises what it sees as the significant relationship between the UK and Pakistan and, particularly, the strong ties many in Scotland have with the country; believes that Pakistani authorities should act in accordance with the rule of law and uphold their obligations under the international treaties which the country is a signatory of; further believes that a fair and lawful judicial process should be applied to all citizens; calls on the appropriate authorities to act in accordance with what it sees as their obligations, and condemns all forms of custodial maltreatment and torture.
