To ask the Scottish Government how much has been awarded from the Regeneration Capital Grant Fund in each of the last five years, also broken down by local authority.

In each of the previous five years of the Regeneration Capital Grant Fund (RCGF), grant offer recommendations have totalled: £27,591,462 in 2014-15; £14,343,059 in 2015-16; £23,297,674 in 2016-17; £23,387,077 in 2017-18, and; £27,045,746 in 2018-19.

18 projects have been recommended to receive grant support in 2019-20 - totalling £16,505,851 for 2019-20 and £3,975,731 for 2020-21.

To ask the Scottish Government whether the Road Traffic Act 1988 prevents a member of the public driving a tractor on the Aberdeen Western Peripheral Route (AWPR) and, if so, which specific law they would be breaking, and what the penalty would be.

The Aberdeen Western Peripheral Route is a “special road”, being a road provided under a scheme made under section 7 of the Roads (Scotland) Act 1984. The relevant schemes for the AWPR are the A90 (Aberdeen Western Peripheral Route) Special Road Scheme 2010 and the A90 (Aberdeen Western Peripheral Route) (Craibstone Junction) Special Road Scheme 2010. Those schemes prescribe the classes of the traffic that may use the AWPR, being classes I and II of Schedule 3 to the Roads (Scotland) Act 1984, which do not include agricultural tractors.

Section 17 of the Road Traffic Regulation Act 1984 provides that a special road shall not be used except by traffic of a class authorised to do so by a scheme made, or having effect as if made, under section 7 of the Roads (Scotland) Act 1984. Section 17 of the Road Traffic Regulation Act 1984 provides that if a person uses a special road in contravention of that section, he is guilty of an offence. Under the Road Traffic Offenders Act 1988 such an offence is punishable by a maximum fine of level 4 on the standard scale (currently £2,500) and 3 penalty points. It would, of course, be a matter for Police Scotland and the Procurator Fiscal to determine whether the law has been broken in any particular case and, if so, what the appropriate penalty would be (within the prescribed limits).

To ask the Scottish Government how many farm businesses are awaiting Basic Payment Scheme payments for 2016.

For 2016 we have paid 17870 businesses. There is currently one business awaiting a 2016 Basic Payment Scheme Payment. As in any year there can be a number of complex cases which require investigation to determine eligibility. In this case the issues have now been resolved and the payment will be processed in the next 2016 payment run at the earliest opportunity.

Nationally for the 2017 scheme year we have paid 99.28%.

And I am pleased to advise the Chamber that 2018 BPS payments have started this week and as of yesterday (Wednesday 20 March), payments were made to 1546 businesses. The gross value of payments made was nearly £45 million (£44,909,116).

To ask the Scottish Government how many farm businesses in (a) the Highlands, (b) Aberdeenshire and (c) each parliamentary region are waiting to receive 2016-17 CAP basic payments.

Nationally, for 2016 we have paid 99.65% of BPS payments and for 2017 99.28%

A) 0 payments due in the Highlands for the 2016 scheme year.

8 are due a payment for the 2017 scheme year and a further 6 farm businesses are currently under assessment for 2017 and could become eligible for a payment in future.

B) 1 payment due in Aberdeenshire for the 2016 scheme year.

2 are due a payment for the 2017 scheme year and a further 3 farm businesses are currently under eligibility assessment for 2017

C) 1 Basic payment due for the 2016 scheme year in the North East Scotland Region
