To ask the Scottish Executive when the Serious Organised Crime Taskforce will report its findings.
Answer
The Serious Organised Crime Taskforce aims to identify priorities for tackling serious organised crime in Scotland by making recommendations to Scottish ministers; sharing best practice; improving co-ordination between the law enforcement agencies, and making proposals for legislation and other measures to tackle serious organised crime.
There have been a number of announcements of recommendations and priorities following taskforce discussions. For example, we have already announced our intention to bring forward proposals for offences of directing or being involved in organised crime; that we are reinvesting a proportion of proceeds of crime back into asset recovery work; that I have written to the Home Secretary with suggestions for strengthening the Proceeds of Crime Act 2002 and we have drawn attention to some recent successes by the agencies involved in tackling organised crime. We will publish our proposals for legislative change when it is appropriate to do so.

To ask the Scottish Executive whether there is a limit to the number of community service orders that can be given to an individual before a prison sentence is imposed.
Answer
There is no such limit. Courts have regard to the specific circumstances of the offence and the individual offender, before deciding on a sentence.

To ask the Scottish Executive, further to the answer to question S3W-13585 by Kenny MacAskill on 5 June 2008, what criteria are used to calculate the amount of money collected from each commission area district court that is forwarded to HM Treasury.
Answer
Information on the amount of money collected by each commission area district court and forwarded to HM Treasury is provided to the Scottish Government by the individual local authorities in each commission area. They do not detail the specific criteria they have used in making these returns, however the basis on which money could be retained or forwarded in 2006-07 and previous years was as follows:
Local authorities were allowed to retain all income from fiscal fines and from fines imposed upon conviction for common law offences. They also retained a set proportion of income received for fixed penalty notices for certain road traffic offences. This proportion was set at 10%, but increased to 33% in the case of penalties for stationary vehicles where the fine became registered. Money received from fines imposed upon conviction for statutory offences was forwarded to HM Treasury, as was the balance of fixed penalty notice payments for road traffic offences.
