Whilst different staff groups within NHSScotland do work under different terms and conditions, the standard subsistence rates contained within these terms and conditions are currently the same. These rates are uniform and do not change according to the seniority of the claimant within a given staff group.

Any changes to current terms and conditions for NHS staff, including subsistence rates, would be discussed on a UK-wide basis between health service trades unions and staff representative groups, NHS employers and UK health departments through the relevant negotiating machinery. No such discussions are currently taking place.

The information is contained in the following table. The column headed Basic Employer gives the percentage of total local authority expenditure relating to employers'' contributions for existing members. The column headed Additional Employer gives the percentage of local authority expenditure in cases where a member has been given early retirement and as a consequence councils have paid a strain cost to the relevant Local Government Pension Fund.

The Department for Business Enterprise and Regulatory Reform provides data for Scotland going back to 1990 for gas and electricity expenditure but only broken down by payment method – with no total.

The same Departmental site also provides UK expenditure on domestic electricity and gas going back to 1974 (Table 2.6.2 Average Expenditure Each Week on Fuel per Consuming Household). A comparison of levels of expenditure in Scotland and the UK can be made where statistics exist from both data sources for a particular year.

From the average ratio of these comparisons, the average annual domestic expenditure on (a) gas and (b) electricity can be constructed for Scotland back to 1974.

“Average” household income figures are very skewed by high income earners. Their incomes distort the average household income figure. Therefore the “Median” household income is the preferred central measure. It is available for Scotland from the Department of Work and Pensions Households Below Average Income data series for the period 1994-95 to 2006-07.

Therefore, on a consistent basis, using median household disposable income, the proportion of household income spent on (a) gas and (b) electricity is available for the period 1994-95 to 2006-07. The figures for these measures are shown in the following table.

I refer the member to the Foreign Secretary’s written statement to the House of Commons on 3 July (Hansard 58WS). The Scottish Government welcomes confirmation by the US Authorities that there has been no use of Scottish airports for rendition flights since September 2001, and their confirmation that there will be no use of UK territories by such flights in future without the express permission of the UK Government. As you will see, the Foreign Secretary has confirmed that such permission would only be granted if the UK Government was satisfied that the rendition would accord with UK law and our international obligations. The Scottish Government remains firmly opposed to rendition flights and believes that they could never be in accordance with domestic or international law. Therefore, we continue to expect that there will be no use of Scottish territory for this purpose under any circumstances.

Information on the number of dogs seized is not held centrally.

The terms and conditions under which privately owned and run car parks operate are a matter for the owner and operator of the car park.

Privately operated car parks are not subject to the provisions of the Road Traffic Regulation Act 1984 but they do come within the scope of the Trade Descriptions Act 1988 and the Consumer Protection Act 1987, which protect motorists from false trade descriptions about the provision of car parking and also from misleading indications of the costs of car parking.

In disputed cases, legal advice should be sought: the basis for imposing or purporting to impose any sort of charge will differ according to the specific situation under consideration.
