To ask the Scottish Executive how many (a) recorded cases, (b) prosecutions and (c) convictions under (i) section 3 of the Sex Offenders Act 1997 and (ii) section 91 of the Sexual Offences Act 2003 there have been in each year since they came into force, broken down by police force area.

The available information is given in the following tables. For part (a) of the question, figures for crimes recorded by the police under the legislation stated are not available separately. Total figures for the criminal offence of “failing to notify the police or providing of false information” are therefore presented.

The statistics dealing with recorded crime and court proceedings are not directly comparable as a person may be proceeded against for more than one crime involving more than one victim and there is the possibility that the crime recorded by the police may be altered in the course of judicial proceedings. Also a crime may be recorded by the police in one year and court proceedings concluded in a subsequent year.

To ask the Scottish Executive how many (a) males and (b) females have been (i) prosecuted and (ii) convicted of sectarian violence in each year since 1999, broken down by age and police force area.

Sectarian violence is not a separatecharge - any charge may have a variety of aggravations added and one of the optionsis religious. The following tables show the number of charges relating to violentoffences with religious aggravations where (1) the charge was prosecuted and (2)the prosecution led to a conviction since the introduction of religious aggravationsin 2003.

Table 2 shows those charges witha Guilty verdict recorded for the charge. Of the 5 female accused who were convicted,3 also had the religious aggravation taken into account, and of the 45 male accusedwho were convicted, 25 also had the religious aggravation taken into account. Sevencharges relating to male accused in Strathclyde are still the subject of court proceedings.

Notes:

1. The information in these tableshas been extracted from the Crown Office and Procurator Fiscal Service’s case managementdatabase. The database is a live, operational database used to manage the processingof reports submitted to procurators fiscal by the police and other reporting agencies.

2. The database is charge-based.The figures quoted therefore relate to the number of charges rather than the numberof individuals charged or the number of incidents that gave rise to such charges.

3. If a Procurator Fiscal amends a charge submitted by areporting agency the database will record details only of the amended charge. Similarly,if a religious aggravation is included by the police but removed by the ProcuratorFiscal, this cannot be identified in the database.

To ask the Scottish Executive how much was spent by each of its (a) departments, (b) agencies and (c) non-departmental public bodies in respect of hotel and other privately-provided accommodation (i) in Scotland, (ii) in the United Kingdom and (iii) abroad for (1) ministers, (2) staff and (3) other persons in each year since 2001-02.

The information we hold centrallycannot be broken down to provide all the information requested (other than at disproportionatecost). The following table provides details of the expenditure on motor mileageand subsistence for the departments and agencies that use the Scottish ExecutiveAccounting System. The figures therefore include, in addition to accommodation,expenditure on meals, day subsistence, personal incidental allowances, detachedduties, certain permanent transfer expenses and motor mileage. I am unable to providea breakdown of expenditure by location, type of accommodation or by category ofpersonnel.

We regard it as crucial thatstaff and ministers get out and about in the course of their work to meet stakeholdersand the general public and these expenses were all incurred in that context. Thebasis for allowable expenses is clearly set down and cases are rigorously authorised.
