To ask the Scottish Executive when it plans to lay before the Parliament the Scottish Outdoor Access Code, defined in the Land Reform (Scotland) Bill.
Answer
Part 1 of the Land Reform (Scotland) Bill would place a duty on Scottish Natural Heritage (SNH) to draw up the Scottish Outdoor Access Code and issue it. The process of drawing up and issuing the code is a matter for SNH. I understand, however, that SNH intends to reconvene the Access Forum next month, with a view to finalising a draft of the code and issuing it for public consultation before the end of March 2003. The organisations to be involved in drafting the code is a matter for SNH, but all interested parties will have the opportunity to make their views known during the consultation phase. The bill would require that SNH submit the proposed code to ministers for approval. I understand SNH hope to be in a position to submit the code to ministers in the autumn. Following their approval, the bill would require that the code is approved by Parliament before it can be issued. I hope that this will be achieved this year.
