To ask the Scottish Government when the handover will take place between the current independent custody visiting schemes and the statutory scheme under the Police and Fire Reform (Scotland) Act 2012.
Answer
Officials are currently working with custody visiting scheme administrators to consider options and recommendations for a new statutory scheme under the reform agenda. Decisions on the detailed operation of the new scheme have not yet been taken.

To ask the Scottish Government whether there is a legal reason for witnesses not being informed of the result of a pleading diet until they receive a citation to appear in court.
Answer
There is no legal reason to prevent witnesses being informed of the result of a pleading diet prior to the receipt of their citation to appear in court and the information can be provided to victims and witnesses from the Scottish Court Service or Crown Office and Procurator Fiscal Service (COPFS). COPFS (through its Victim Information and Advice service) is pro-active in providing information to victims about the dates of court hearings prior to the issue of a citation, where the case involves solemn proceedings, domestic abuse, hate crime or a sexual offence and in cases involving children and vulnerable victims and witnesses or in any case involving a death.

To ask the Scottish Government whether Professor Andrew Coyle's review of the proposals on the independent monitoring of prisons will examine all of its proposals or the most recent proposal only.
Answer
Professor Andrew Coyle will be carrying out an independent review of the Scottish Government’s proposals, as announced to stakeholders in August, to replace the Prison Visiting Committees with a new monitoring service. The new service, under the auspice of Her Majesty’s Inspectorate of Prisons for Scotland, will be made up of four Senior Monitors supported by lay monitors.

The remit for Professor Andrew Coyle’s independent review of the Scottish Government’s proposals on the independent monitoring of prisons will be to consider specifically:
the extent to which the proposals meet the government’s obligations under the Optional Protocol to the UN Convention Against Torture (OPCAT)
responses of prisoners, prison staff and stakeholders to the new proposals
independent monitoring of legalised police cells.
It is for Professor Andrew Coyle to decide how he conducts the independent review.
