To ask the Scottish Executive what process and codes were followed and which individuals were involved in the re-appointment of Harold Mills as Chairman of Caledonian MacBrayne.
Answer
The reappointment was carried out in line with the Commissioner for Public Appointments' Code of Practice. It was made by ministers on the basis of a performance assessment prepared by officials in the Scottish Executive Development Department, the department sponsoring Caledonian MacBrayne Limited.

To ask the Presiding Officer, further to his answer to question S1W-26404 on 11 June 2002, who was responsible for commissioning the due diligence procedures on Flour City Architectural Metals (UK) Ltd and whether the procedures were completed prior to the issuing of the contract.
Answer
The Construction Manager, Bovis Lend Lease (Scotland) Limited, was responsible for conducting due diligence procedures, which were completed before the contract was awarded.

To ask the Scottish Executive what process was followed to appoint the First Minister's principal special adviser.
Answer
Provision for the appointment of special advisers is made in article 3 (4) of the Civil Service Order in Council 1995 as amended by the Civil Service (Amendment) Order in Council 1999. These provisions give the First Minister delegated authority from the Prime Minister to appoint up to 12 special advisers without further recourse to him. Nine special advisers are currently in post. They were selected by the First Minister and Deputy First Minister respectively, without advertisement.Special advisers are temporary civil servants. They are appointed to advise Ministers within the terms of the Model Contract for Special Advisers, which includes a special adviser code of conduct. The Model Contract, which sets out the sorts of work a special adviser may do as well as arrangements for pension and explanation of duration of contract, is available in the Parliament's Reference Centre (Bib. number 22440). Special adviser's salaries are not revealed in order to protect the privacy of the individuals concerned. However, the special advisers' salary ranges for 2002-03 are shown in the following table:

To ask the Scottish Executive whether the First Minister decides how many civil servants there should be in the Scottish Executive, associated departments, executive agencies and non-departmental public bodies.
Answer
Ministers exercise overall control of administration expenditure by the Scottish Executive, associated departments, executive agencies and non-departmental public bodies through the budget approval process. In practice, within these approved budgets managers determine their staffing requirements.
