To ask the Scottish Executive what discussions it has had with the UK Border Agency regarding the awarding of the contract for the provision of accommodation for asylum seekers in Scotland to Serco.
Answer
The responsibility for the award of this contract is a reserved matter. However, Scottish Government officials have been kept informed by UKBA officials during the tendering process and initial roll out of the contract for the provision of accommodation for asylum seekers which was awarded to Serco earlier this year.
In December 2011, the Cabinet Secretary for Culture and External Affairs wrote to Home Office Minister, Damian Green MP expressing her concerns that the change in contract would not adversely affect the lives of asylum seekers living in Scotland, and noting that she wished to be kept fully informed of any developments.
The Scottish Government remains clear that whilst asylum seekers are in Scotland they must be welcomed and supported.

To ask the Scottish Executive whether private contractors operate under Scots Law in relation to their involvement in the practice of dawn raids.
Answer
Individuals in Scotland are subject to Scots criminal law. They may also, depending on the facts and circumstances of a particular case, owe civil law obligations to other persons.
Asylum and Immigration regulations are reserved matters and decisions relating to the use of private contractors in dawn raids undertaken in the enforcement of those regulations, are for the UKBA. However, anyone involved in dawn raids and present in Scotland is subject to Scots Law.

To ask the Scottish Executive how it will ensure local community access to the Cities Investment Fund.
Answer
The Cities Investment Fund is designed to accelerate the pace of investment in our cities by: developing programmes which lever in other funding; supporting collaborative programmes between cities which will develop large-scale projects; and developing programmes which allow for wider city region investment.
The detailed criteria for the fund will be finalised after consultation with the six city local authorities and with COSLA.

To ask the Scottish Executive whether the revenue generated by a social responsibility levy will be available for investment in groups working with alcohol addiction.
Answer
The Alcohol etc. (Scotland) Act 2010 allows Scottish Ministers to make by regulations provision about how the income from the social responsibility levy may be applied.
The Scottish Government has been clear that the levy will not be taken forward until the economic circumstances are right.

We are working to publish the strategy by the end of 2011 and all six cities are fully engaged in working collaboratively with Scottish Government to identify specific areas where a cities strategy can add most value.
