Under item 3, we will consider an instrument that has been laid under the European Union (Withdrawal) Act 2018. The committee is considering whether the appropriate scrutiny procedure and the appropriate category have been applied to the following instrument.
Animal Products (Transitional Import Conditions) (Miscellaneous Amendment) (Scotland) Regulations 2021 (SSI 2021/432)
The instrument was laid under the negative procedure and the Scottish Government considers it to be of low significance. Is the committee content that the appropriate scrutiny procedure has been applied?

Members will note that the instrument removes the requirement for products of animal origin and animal by-products to be accompanied by health certificates. That differs from previous instruments, which postponed the implementation of border control measures. As the approach appears to constitute a policy choice, does the committee agree that the categorisation should be of medium, rather than low, significance?
