Letter from the Convener to the Lord President of the Court of Session, 25 February 2022
Dear Lord Carloway
Thank you for your letter of 20 January 2022 in relation to the Act of Sederunt (Summary Applications, Statutory Applications and Appeals etc Rules 1999 and Sheriff Appeal Court Rules Amendment) (Age of Criminal Responsibility (Scotland) Act 2019) 2021 (SSI 2021/452).
You will also recall that I wrote to the Minister for Parliamentary Business in relation to the instrument. I have also received the Minister’s response dated 19 January 2022.
The Committee noted from the responses the differing views of the level of communication that had taken place between the Scottish Government and Scottish Civil Justice Council. I have therefore written again to the Minister to ask whether he intends to make any changes to how the Scottish Government communicates with the Scottish Civil Justice Council and your own office in relation to any future legislative changes.
