Letter from the Chair of the Scottish Law Commission to the Convener, 18 October 2021


Dear Stuart

Thank you for your letter of 5 October, and also for the opportunity to give evidence to your Committee on 28 September.   I indicated at the meeting that I would keep you updated on the anticipated reference to the Commission from the Scottish Government.  This concerns recommendations in the Working Group’s Report on Maintenance of Tenement Scheme Property dated 4 June 2019. 

I am pleased to say that there has been good progress at official level in agreeing the terms of a draft reference and I am hopeful that it will be formally agreed in the near future.  The currently envisaged timescale for our work would see us submitting a report by Spring 2026.  This will allow for full research and public consultation on the relevant issues, and also takes account of the team’s existing work in relation to the Heritable Securities project.

I am happy to let you know once we have formally agreed terms of reference.

In addition to the issue of a reference on tenements, another matter which came up at the meeting on 28 September concerned a visit by the members of your Committee to the Commission’s offices.  This would allow you to meet all of the Commissioners.  We would like to extend an invitation as soon as the public health situation allows us to hold such an event safely, and Charles Garland will be in touch with your Clerk about that.
