Overview

This Bill makes it clear that the census can include questions on sexual orientation and gender identity.

It proposes that questions about these matters would be voluntary, like questions about religion are. Normally, it’s a criminal offence not to answer census questions. 

Why the Bill was created

The census is the official count of every person and household in Scotland. It’s held every 10 years and provides the most complete statistical picture of the country. 

It provides information to monitor discrimination and help central and local government improve public services. 

Scotland's census is taken by the National Records of Scotland (NRS) on behalf of the Registrar General for Scotland. 

Between 8 October 2015 and 15 January 2016, the NRS asked for views on the topics people felt should be included in the next census. Gaps were identified on sexual orientation and gender identity. 

Including these questions would provide data for planning public services in line with the Equality Act 2010

Questions on these matters may be added for the 2021 census. How they would be asked is still to be decided.

Stage 1: general principles

At Stage 1, the Bill is given to a lead committee. This is usually the committee whose remit most closely relates to the subject of the Bill. The lead committee will consider and report on the Bill. Other committees may also examine the Bill and report to the lead committee. Finally, there is a debate and vote by all MSPs on the general principles of the Bill. If the general principles are not agreed to, then the Bill ‘falls’ and can’t become law.
